The Nostalgia Time Machine Creator Rewards Programme is operated by Nostalgia Time Machine Limited, trading as Nostalgia Time Machine (“Nostalgia Time Machine”, “we”, “us” or “our”).

The Programme allows eligible customers (“Creators”, “you” or “your”) to earn rewards by referring new customers to Nostalgia Time Machine using a unique Creator Code.

The Programme is intended to reward genuine referrals and promotional activity. Participation does not create an employment, agency, partnership or other representative relationship between you and Nostalgia Time Machine.

To participate in the Programme, you must:

• be at least 18 years old;
• be legally capable of entering into a binding agreement;
• purchase a Nostalgia Time Machine Pack using an approved Creator sign-up code;
• provide accurate and up-to-date contact and payment information when requested; and
• comply with these Terms & Conditions and all applicable laws, regulations and platform rules.

We may refuse, suspend or remove a Creator where we have a reasonable business reason to do so, including where we reasonably suspect:

• fraud or attempted fraud;
• abuse or manipulation of the Programme;
• a breach of these Terms & Conditions;
• unlawful activity;
• misleading or deceptive marketing; or
• conduct that could reasonably cause material reputational harm to Nostalgia Time Machine.

Where appropriate, we may investigate the circumstances before making a final decision.

You become eligible to participate in the Programme by purchasing a Nostalgia Time Machine Pack using an approved Creator sign-up code.

Once the qualifying purchase has been verified, Nostalgia Time Machine may issue you with a unique Creator Code.

Your Creator Code remains the property of Nostalgia Time Machine. We may amend, suspend, replace or withdraw a Creator Code where reasonably necessary for operational, security, fraud-prevention or Programme-management reasons.

Each approved Creator will receive a unique Creator Code.

Your Creator Code:

• may be shared through social media, websites, blogs and other lawful marketing channels;
• allows eligible customers to receive the promotional discount specified by Nostalgia Time Machine;
• must not be sold, transferred or assigned to another person;
• must not be used in a misleading, deceptive, unlawful or abusive manner; and
• must not be used in a way that suggests you are an employee, agent or official representative of Nostalgia Time Machine unless we have expressly authorised this in writing.

We may deactivate or replace a Creator Code where reasonably necessary for operational, security or fraud-prevention reasons.

A “Qualifying Sale” is a sale that:

• is completed using a valid Creator Code;
• has been paid for in full;
• has not been cancelled;
• has not been refunded;
• has not been subject to a chargeback or payment dispute; and
• is not reasonably suspected to have resulted from fraud, abuse or manipulation of the Programme.

Purchases made by a Creator using their own Creator Code do not count as Qualifying Sales.

We may also exclude transactions where there is a reasonable basis to believe that the transaction was created primarily to obtain Programme rewards rather than as a genuine customer purchase.

Nostalgia Time Machine's sales and tracking records will be used to determine whether a transaction qualifies for rewards.

Where there is a genuine dispute regarding the tracking or qualification of a sale, we will review the relevant information reasonably available to us and make a decision in accordance with these Terms & Conditions.

Creators earn rewards based on verified Qualifying Sales.

Standard Creator Rewards

You will earn £10 for every 5 verified Qualifying Sales.

For example:

5 verified sales = £10 reward

10 verified sales = £20 reward

15 verified sales = £30 reward

20 verified sales = £40 reward

25 verified sales = £50 reward

Verified Qualifying Sales carry forward towards the next reward threshold. For example, if you have 7 verified Qualifying Sales, the additional 2 sales will remain credited towards your next 5-sale threshold.

Rewards are earned only after the relevant sales have been verified by Nostalgia Time Machine.

A Creator who reaches 25 verified Qualifying Sales becomes eligible for Gold Creator Status.

Gold Creator Status includes:

• a one-off £50 Gold Creator Bonus; and
• increased rewards of £15 for every subsequent 5 verified Qualifying Sales.

At 25 verified Qualifying Sales, the total rewards earned will be £100, consisting of:

£50 in Standard Creator Rewards; and

£50 Gold Creator Bonus.

Once awarded, Gold Creator Status will remain active unless:

you voluntarily leave the Programme;

the Programme is discontinued;

your Creator account becomes inactive under Section 11;

you are removed from the Programme for breach of these Terms & Conditions; or

Gold Creator Status is otherwise ended in accordance with a permitted change to the Programme.

Rewards are normally reviewed and processed on a monthly basis.

Before approving a payment, we may:

• verify sales activity;
• review cancellations, refunds and chargebacks;
• request confirmation of your identity or payment details;
• investigate suspected fraud, abuse or unusual activity; and
• check compliance with these Terms & Conditions.

A reward becomes approved and payable once the relevant Qualifying Sales have been verified and the reward has been approved by Nostalgia Time Machine.

We may delay payment while we reasonably investigate suspected fraud, abuse, incorrect tracking or non-compliance with these Terms & Conditions.

We will aim to complete such reviews within a reasonable period.

Rewards may be paid by bank transfer or such other payment method as Nostalgia Time Machine may specify from time to time.

Where payment details are required, Creators will be contacted using the email address, Etsy messaging account, social media account, or other contact details associated with their participation in the Programme.

Creators are responsible for ensuring that any payment details supplied are accurate and up to date.

Nostalgia Time Machine will not be responsible for payments sent to incorrect payment details provided by the Creator.

Payments will be made using a payment method made available or specified by Nostalgia Time Machine.

You are responsible for determining and complying with any tax, reporting or accounting obligations arising from rewards received through the Programme.

An approved reward must be claimed, or valid payment details must be supplied, within 12 months of the date on which the reward was approved.

If you do not claim an approved reward or provide valid payment details within this period, the reward may expire and be forfeited.

You may contact Nostalgia Time Machine at any time to request confirmation of your current approved reward balance.

You are responsible for ensuring that your promotional activity complies with all applicable laws, regulations, advertising rules and platform requirements.

Where required, you must clearly disclose that you may receive a reward when customers purchase through your Creator Code.

Your advertising disclosure should be clear, prominent and easy for your audience to understand.

Depending on the platform and circumstances, appropriate disclosures may include:

• #Ad
• #Advert
• #Affiliate

a clear paid-partnership or equivalent platform label.

Because Creator Code promotions are performance-based, content promoting Nostalgia Time Machine through your Creator Code may constitute advertising. You should therefore ensure that the commercial nature of the content is clear to your audience.

You must not:

• make misleading, false or unsubstantiated claims about Nostalgia Time Machine or its products;
• create or publish fake reviews or testimonials;
• present another person's review or experience as your own;
• misrepresent your relationship with Nostalgia Time Machine;
• suggest that you are an employee, agent or official representative of Nostalgia Time Machine unless expressly authorised in writing;
• make claims about product features, prices, discounts or benefits that are not accurate; or
• use advertising methods that are unlawful, deceptive or prohibited by the relevant platform.

Failure to comply with these requirements may result in suspension or removal from the Programme.

If you generate no Qualifying Sales for a continuous period of 12 months, Nostalgia Time Machine may designate your Creator account as inactive.

An inactive Creator account may be closed and its Creator Code may be withdrawn.

Any approved rewards that remain within their applicable expiry period will remain payable, subject to these Terms & Conditions.

If an inactive Creator wishes to participate in the Programme again, we may require a new application or qualifying purchase.

The following activities are prohibited:

• using your own Creator Code for personal purchases;
• creating or operating multiple accounts for the purpose of generating additional rewards;
• generating fraudulent or artificial transactions;
• encouraging customers to make purchases primarily for the purpose of manipulating the Programme;
• manipulating discounts, tracking or reward calculations;
• using bots, automated systems or other methods intended to interfere with Programme tracking;
• sending unsolicited bulk marketing communications;
• engaging in unlawful, misleading or deceptive marketing;

misrepresenting your relationship with Nostalgia Time Machine;

• attempting to interfere with the operation or security of the Programme; or
• otherwise abusing the Programme.

If we reasonably believe that you have breached these Terms & Conditions, we may take one or more of the following actions:

• suspend your Creator Code;
• suspend your participation in the Programme;
• remove you from the Programme;
• cancel rewards that have not yet been paid where those rewards were generated through prohibited or invalid activity; and/or
• take legal action where appropriate.

We will not cancel or withhold legitimately earned rewards solely because you have been removed from the Programme, unless those rewards are themselves affected by the breach, fraud, invalid transactions or another permitted reason under these Terms & Conditions.

We may make reasonable changes to the Programme where necessary for operational, commercial, legal, regulatory, security or fraud-prevention reasons.

Where reasonably possible, we will provide at least 30 days' notice of material changes affecting:

• reward rates;
• bonus structures;
• eligibility requirements; or
• other material Programme benefits.

Changes required urgently for legal, regulatory, security or fraud-prevention reasons may take effect immediately where reasonably necessary.

Unless expressly stated otherwise, changes will not retrospectively reduce or cancel rewards that have already been approved before the effective date of the change.

Where a change affects Qualifying Sales that have been generated but not yet approved, those sales will be assessed under the Terms & Conditions that applied when the relevant customer purchase was made, unless a different approach is required by law or reasonably necessary to prevent fraud or abuse.

Your continued participation in the Programme after a change takes effect will constitute acceptance of the revised Terms & Conditions.

Nostalgia Time Machine may discontinue the Programme.

Where reasonably possible, we will provide at least 30 days' notice before the Programme ends.

Any rewards that have been approved before the Programme termination date will remain payable in accordance with these Terms & Conditions.

Qualifying Sales made before the termination date may continue to be verified and approved after termination, provided they otherwise meet the requirements of these Terms & Conditions.

No new rewards will accrue from Qualifying Sales made after the Programme termination date.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Subject to that, and to the extent permitted by law, Nostalgia Time Machine will not be responsible for:

• indirect or consequential losses;
• loss of profits;
• loss of business opportunities;
• loss of goodwill;
• website or platform outages;
• technical failures outside our reasonable control;
• tracking errors caused by third-party platforms or systems; or
• reasonable delays in reviewing or processing rewards.

Nothing in these Terms & Conditions affects any rights or remedies that cannot lawfully be excluded or limited.

Personal information supplied in connection with the Programme will be processed in accordance with applicable UK data protection legislation and the Nostalgia Time Machine Privacy Policy.

We may use personal information to:

• administer the Programme;
• verify qualifying purchases and sales;
• prevent and investigate fraud or abuse;
• communicate with Creators about the Programme;
• process reward payments; and
• comply with our legal and regulatory obligations.

Privacy Policy

No employment or agency relationship

Participation in the Programme does not make you an employee, worker, partner, agent or representative of Nostalgia Time Machine.

You are responsible for your own promotional activities, tax affairs and legal obligations arising from your participation in the Programme.

Assignment

You may not sell, transfer or assign your Creator account or Creator Code to another person without our prior written consent.

Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the extent necessary, and the remaining provisions will continue to apply.

Entire agreement

These Terms & Conditions, together with any Programme information expressly incorporated into them, set out the agreement between you and Nostalgia Time Machine regarding your participation in the Programme.

These Terms & Conditions are governed by the laws of England and Wales.

Subject to any mandatory rights you may have under applicable law, the courts of England and Wales will have jurisdiction over disputes arising in connection with the Programme.
